Warranty

IFEED TWO-YEAR LIMITED WARRANTY

 

IFEED TECHNOLOGY LLC (“Vendor”) of 35332 SE Center Street, Snoqualmie, WA 98065 USA, warrants to the initial Purchaser (the “Purchaser”) that the iFeed product (the “Product”) is free from defects in workmanship and materials.  The foregoing warranty shall expire two years after shipment of the Product to the initial Purchaser (the "Warranty Period").

 

If Purchaser gives written notice to Vendor during the Warranty Period, Vendor, at Vendor’s option, shall correct any nonconformity of the Product which proves defective, replace the nonconforming Product or refund the purchase price paid by the Purchaser, in each case upon Vendor’s receipt of the defective Product returned to Vendor at Purchaser’s expense pursuant to a Return Item Authorization issued by Vendor.  This warranty shall not apply if the Product has been misused, abused, installed improperly or otherwise exposed to conditions contrary to Vendor’s instructions.

 

Purchaser’s sole and exclusive remedy for breach of the foregoing warranty shall be as set forth herein, whether such breach arises in contract or in tort (including negligence).  IN NO EVENT SHALL VENDOR BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES INCURRED BY PURCHASER, OR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE ABILITY OR INABILITY TO USE THE PRODUCT, TO THE FULL EXTENT THESE DAMAGES MAY BE DISCLAIMED BY LAW.

VENDOR'S OBLIGATIONS UNDER THIS WARRANTY SHALL IN NO EVENT EXCEED THE PURCHASE PRICE ACTUALLY PAID BY PURCHASER TO VENDOR FOR THE DEFECTIVE PRODUCT.

 

THE LIMITED WARRANTY SET FORTH ABOVE IS EXCLUSIVE AND ALL OTHER WARRANTIES OF ANY KIND, WHETHER WRITTEN, ORAL, EXPRESS, STATUTORY OR IMPLIED (WHETHER ARISING UNDER LAW OR EQUITY OR TRADE CUSTOM), INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE, ARE EXCLUDED FROM THIS CONTRACT.

 

Some states and jurisdictions do not allow the limitation or exclusion of incidental or consequential damages, or limitation on the length of an implied warranty, so the above limitations or exclusions do not apply to a consumer-Purchaser in those states or jurisdictions. This limited warranty gives the consumer-Purchaser specific legal rights, and the consumer-Purchaser may also have other rights that vary from state to state or from one jurisdiction to another.  The foregoing shall not apply to a Purchaser who uses the Product for other than personal, family or household purposes.
